Our Mediation Fees

In the context of mediation, a distinction must be made between the case where BeRecht Avocats assists the client in mediation and the case where the client calls upon a mediator from BeRecht Avocats.

 

In this hypothesis, an attorney trained in mediation assists the client to prepare her/him for mediation and advises her/him throughout the process. The remuneration is then that of an attorney in accordance with the fee agreement established with the client.

In this case, the mediator's remuneration is either paid by one of the parties or shared between the parties as agreed between them.


The mediator's fees are set either on a flat-fee basis or on an hourly rate basis.

  •     The hourly rate consists of calculating the fee based on the actual time worked on the case.
  •     The flat fee is a fixed fee, the amount of which, communicated in advance to the client, covers all the work carried out on the case. The flat fee can be proposed for cases where the volume of work can be easily determined in advance.

Not included in the fees, but to be paid by the client, are the additional costs not included in the fees (e.g. expertise costs if the parties wish to use an expert during the mediation), as well as VAT.
